In Thaler v. Perlmutter, the Court held that “work created absent any human involvement” is ineligible for copyright protection, stating, "Human authorship is a bedrock requirement of copyright." What was left undecided in this case is the degree of human involvement required to take a work from being machine-created to being human-created. "Originality" being central to questions of copyright eligibility, most jurisdictions protect only "original" works having a human author. The US Copyright Office has said it will register works that contain "otherwise unprotectable material" but only if the new work contains a "sufficient amount of original authorship".
