The highest court in New York state has overturned former movie mogul Harvey Weinstein's 2020 felony sex crime conviction, citing a lack of a fair trial due to the admission of testimony from women whose allegations were not part of the case. Weinstein has been serving a 23-year sentence in New York based on that conviction. The Manhattan district attorney's office plans to retry the case, and the responsibility now falls on DA Alvin Bragg Jr. who is also involved in another high-profile case involving former president Donald Trump.

In October 2017, The New York Times and The New Yorker reported that dozens of women had accused film producer Harvey Weinstein of rape, sexual assault and sexual abuse over a period of at least 30 years. Over 80 women in the film industry eventually accused Weinstein of such acts. Weinstein himself denied "any non-consensual sex". Shortly after, he was dismissed from The Weinstein Company (TWC), expelled from the Academy of Motion Picture Arts and Sciences and other professional associations, and retired from public view.Criminal investigations into complaints from at least six women took place in Los Angeles, New York City, and London. In May 2018, Weinstein was arrested in New York and charged with rape and other offenses. In February 2020, he was found guilty of rape in the third degree and a criminal sexual act. In March 2020, he was sentenced to 23 years of imprisonment. Weinstein was sentenced to an additional 16 years after being convicted in Los Angeles of one count of rape and two counts of sexual assault. He was sentenced to 16 years in the Los Angeles trial, and his California prison term must be served separately from his New York sentence. On April 25, 2024, the New York Court of Appeals overturned the rape convictions. The Court of Appeals said the trial judge had made "egregious errors". The Court of Appeals ordered a retrial of the rape allegations. He will remain in prison since he was convicted of rape in Los Angeles, however it is unknown if Weinstein will return to California or continue to serve time in New York.

The Weinstein Company, LLC (usually credited or abbreviated as TWC) was an American independent film studio, founded in New York City by Bob and Harvey Weinstein on March 10, 2005. TWC was one of the largest mini-major film studios in North America as well as in the United States. The studio eventually declared bankruptcy in February 2018, with independent studio Lantern Entertainment acquiring a majority of its film library and assets.
